Contractual documents governing Hostynet services.
This is a courtesy translation. The French version is the legally binding document.
Definitions
- Hostynet: provider of hosting services (VPS, game servers) and website design services.
- Client: any natural or legal person subscribing to Hostynet services, including individual consumers as defined by French Consumer Code.
- VPS: virtual private server provided by Hostynet.
- Service: functionalities offered by Hostynet, including VPS, game servers (Minecraft and other games), website design packs, and associated options.
- Game server: a dedicated game hosting instance (e.g. Minecraft, and other supported titles) provided by Hostynet under the HostyCraft brand.
- Website Pack: a fixed-scope website design package (Landing, Showcase, E-commerce, Custom build, etc.) listed on the website design page, including design, development, hosting and maintenance as described per pack.
- Additional Hours: prepaid hour packs (1h / 5h / 10h / 20h) used for modifications beyond the monthly inclusive maintenance scope, valid 12 months from purchase.
- Premium Support: priority assistance via the official ticket system, which may include managed services upon Client instruction.
Terms of Sale
1. Purpose
These Terms of Sale govern the sale and provision of Hostynet services: Cloud VPS, game servers and website design services. Any order implies unreserved acceptance of these terms (Articles 1101 et seq. of the French Civil Code).
Pre-contractual information (B2C)
In accordance with Art. L111-1 et seq. of the French Consumer Code, consumer Clients receive the following information before any commitment: seller identity and contact details, main characteristics of the service, total price including tax, duration and conditions of performance, withdrawal conditions and legal guarantees.
2. Services and pricing
Hostynet markets two families of hosting services: (i) Cloud VPS (dual-stack IPv4 + IPv6 VPS in France, IPv6-only VPS and a free trial offer) and (ii) game servers (12 games, plans billed by allocated RAM, including Minecraft under the HostyCraft brand). All prices include VAT where applicable.

A free VPS trial offer is available, under the conditions of Article 13.
Game servers (Minecraft under the HostyCraft brand, Palworld, Rust, ARK, Valheim, CS2, 7 Days to Die, Project Zomboid, Garry's Mod, Terraria, Arma 3, Arma Reforger) are billed by allocated RAM: 2 GB (2.99 € incl. VAT/month), 4 GB (4.99 €), 8 GB (9.59 €), 12 GB (13.19 €), 16 GB (19.19 €), 32 GB (27.59 €). Minecraft HostyCraft plans start at the 8 GB tier. A free HostyCraft offer is available under the conditions of Article 13.
3. Order, instant activation and payment
Orders via hostynet.fr and the client area dashboard.hostynet.fr.
Immediate payment required by bank card (securely processed by Revolut Business); any Hostynet credits available on the client account are deducted from the amount due. The service is activated automatically after payment, usually within a few minutes.
When ordering, the Client ticks two mandatory boxes: acceptance of these Terms and authorisation of the automatic monthly charge on the saved card. Before confirming, the Client is also informed that the service is activated immediately after payment: they request its immediate performance and acknowledge losing their right of withdrawal once the service is fully performed, in accordance with Article L221-28, 1° of the French Consumer Code.
The monthly subscription renews automatically by charge at each due date. The Client may cancel at any time from their client area; cancellation takes effect at the end of the current period, without pro rata refund.
In case of payment failure: service suspension after 3 days of non-payment, termination and permanent deletion of data after 7 days of non-payment.
4. Duration and commitment
Billing period: monthly, automatically renewed by charge on the saved card until cancelled by the Client from their client area.
5. Right of withdrawal
The 14-day right of withdrawal does not apply to Clients who request immediate activation of the ordered service (VPS or game server), in accordance with Article L221-28, 1° of the French Consumer Code.
6. Consumer mediator
In accordance with Article L612-1 of the French Consumer Code, the client may use the mediator free of charge: CM2C, 14 rue Saint-Jean, 75017 Paris, www.cm2c.net.
7. Deployment, availability and SLA
Hostynet commits to providing the Services with a target monthly availability rate of 99%, calculated per calendar month, excluding exclusion periods defined below. This commitment constitutes a reinforced best-efforts obligation and not an obligation of result.
The following are not included in the availability calculation:
- scheduled or emergency maintenance operations,
- interruptions due to force majeure (Article 1218 of the French Civil Code),
- incidents resulting from misuse, misconfiguration or Client intervention,
- failures from third-party providers (network, transit, DNS, power, carriers),
- cyber attacks, including volumetric network attacks or intrusion attempts,
- downtime related to software or hardware updates,
- any event beyond Hostynet's reasonable control.

Any credit request must be submitted in writing within seven (7) calendar days following the end of the relevant month. Hostynet's liability is strictly limited to the amount paid for the affected service over the last thirty (30) days. Hostynet shall not be liable for indirect damages such as loss of revenue, data loss, lost profits or reputational harm.
8. Client obligations
- Use the Service lawfully.
- No spam, crypto-mining, network attacks, malicious content.
- Keep credentials confidential.
- Maintain personal backups.
- Respect technical limitations and network policies.
- Do not resell or sublet the Service without Hostynet's written consent; player access to a game server naturally remains allowed.
9. Termination for breach
Hostynet may immediately suspend or terminate the service for breach of these Terms.
10. Customer support
Official support via ticket system. Discord is community-only.
Indicative response time: Hostynet aims to respond within 24 business hours. This is indicative and not a contractual commitment.
11. Intellectual property
Software provided remains the property of Hostynet or its partners. Reproduction is prohibited.
12. Data protection / GDPR
Hostynet processes personal data in compliance with Regulation (EU) 2016/679 (GDPR).

VPS access (managed services / premium support)
Under standard service, Hostynet does not access VPS content or Client admin credentials.
For managed services / premium support, Hostynet may intervene on the VPS only upon Client request and consent, via the ticket system or other written means. Required access must be provided by the Client as temporary credentials.
Access in case of abuse, security incident or legal obligation
By way of exception to the two principles above, and independently of any managed-services subscription, Hostynet reserves the right to access the VPS (including via the guest agent, the console, or the storage medium) without the Client's prior request or consent, solely in the following cases: (i) reasonable suspicion of abusive or unlawful use (spam, outbound scanning or attacks, hosting of manifestly illegal content, compromise, circumvention of free-trial or multi-account rules); (ii) a security incident affecting or threatening the infrastructure or other clients; (iii) a legal obligation or request from a competent authority. Such access is strictly limited to what is necessary for diagnosis, evidence preservation and protection of the infrastructure. It is logged and, unless legally prohibited or where it would jeopardise the investigation, the Client is informed within a reasonable time.
SSH authentication (security policy)
When placing the order, the Client chooses the VPS authentication method: SSH public key (recommended) or root password. Hostynet recommends SSH keys, which are more secure. If the Client selects password authentication, a strong random root password is generated and password login is enabled on the VPS.
If the Client opts for SSH key authentication, they provide a valid public key (OpenSSH format, ed25519 or RSA 4096-bit minimum) at order time; it is automatically injected into the VPS at provisioning via cloud-init. A guide to generating and managing SSH keys is available in the Hostynet knowledge base.
The Client is solely responsible for securely storing their credentials (private key or password). Hostynet does not store and will never request the Client's private key. In case of loss of access, the Client may at any time replace the authorized public key or reset access via their client area (tab SSH Keys on the service page), and can regain control using the web console (noVNC) available in their client area on the service page.
IP addresses, network and traffic
Attribution. Each VPS receives a dedicated set of IP addresses allocated from Hostynet's pools: (a) dual-stack VPS: 1 public IPv4 address + 1 public IPv6 address; (b) IPv6-only VPS: 1 public IPv6 address. Additional IP addresses are not offered as a paid add-on at this stage.
Release on termination. Upon service termination, the IP addresses are released immediately and may be reassigned to another Client without notice.
Reverse DNS (PTR). Hostynet sets a generic PTR record for each IP. Custom reverse DNS on Client request is not offered. The Client retains full control of forward DNS (A / AAAA records) on their own registrar.
Outbound mail (SMTP port 25). Outbound SMTP on port 25 is blocked by default on all Hostynet VPS to prevent spam abuse and protect the global reputation of the IP pool. Clients wishing to send emails from their VPS must use an external transactional email relay or authenticated SMTP (TCP/587 with SMTPS/STARTTLS) towards their own third-party provider.
Network isolation (anti-pivot). Each Hostynet VPS is network-isolated from the other Hostynet VPS infrastructure by default (firewall rule at hypervisor level). A compromised VPS therefore cannot attack its neighbors. Internet connectivity is preserved. Clients needing private communication between their own VPS may request an explicit exception via support at no extra cost.
Blacklist / RBL responsibility. The Client is solely responsible for the network behavior of their services. If their IP ends up listed on an external RBL (Spamhaus, SpamCop, UCEPROTECT, etc.) following their usage, Hostynet will not intervene to request delisting - the Client must contact the listing organization directly. In case of confirmed abuse (spam, outbound scan, participation in volumetric attacks, compromise not reported), Hostynet reserves the right to suspend the service immediately and without prior notice. A one-time IP reassignment may be granted in good faith. Subsequent reassignments are subject to a €20 ex-VAT administrative fee or may be refused.
Traffic / fair use. Network traffic is not billed by volume. The guaranteed bandwidth is capped per offering (see the product grid). Hostynet reserves the right to intervene in case of manifestly abusive or off-profile VPS usage (e.g., participation in an amplification attack, continuous bot traffic saturating the link, etc.). No bandwidth overage charges apply.
Technical sub-processors (summary)
Hostynet may use providers strictly necessary for service delivery (network connectivity, IP addressing, domain name, payment processing). The up-to-date list is published in the Privacy Policy.
Data retention (summary)
Hostynet may retain technical and security logs for a maximum of 12 months. Service-related data is deleted within 30 days after end of service, unless required by law or prior restitution request from the Client.
13. Free trial offer (24 hours)
Hostynet may offer a free 24-hour trial for certain services (VPS, game servers). The trial gives access to the service under the following conditions:
- Duration: 24 hours from activation.
- No automatic conversion: the trial does not automatically convert into a paid subscription. When the 24 hours expire, the service is suspended, then permanently deleted with its data after a short grace period (12 hours). No charge is applied.
- Limitations: the trial may include technical restrictions (resources, network, features) compared to a paid subscription.
- One trial per client: the free trial is limited to one per product per 30-day period; this limit is enforced in particular through the email address and IP address. The offer is also subject to the number of free slots open on the platform. Any circumvention attempt may result in account suspension.
- No right of withdrawal: where the client requests immediate activation of the trial service, the 14-day right of withdrawal does not apply in accordance with Article L221-28, 1° of the French Consumer Code.
- Availability: Hostynet reserves the right to modify, suspend or discontinue the trial offer at any time without notice.
14. Website design service
In addition to its hosting services, Hostynet provides fixed-scope website design packs (Landing, Showcase, E-commerce, Custom build) detailed on the website design page. Prices are published per pack (FR pricing in € ex-VAT, DZ pricing in DA, VAT-exempt as out-of-EU export under Article 259-1 of the French General Tax Code).
14.1 Quote, order and payment schedule
Each website design order starts with a written quote issued by Hostynet on the basis of the Client's request (via the quote form or direct exchange). The quote sets the chosen pack, scope, deliverables and price. Signature of the quote (or its acceptance by email) constitutes formation of the contract.
Accepted payment methods: bank card (processed by Revolut Business) or bank transfer against invoice. Invoices are issued in € (FR clients) or DA (DZ clients).
14.2 Delivery timeline
Indicative delivery timelines: 2-3 days for Landing, 5-7 days for Showcase, 10-15 days for E-commerce. Custom builds are timed in the dedicated quote. The clock starts upon receipt of (i) the 30% deposit and (ii) the Client's base content (texts, photos, logo). Delays attributable to late or incomplete content from the Client are not deducted from the delivery commitment.
14.3 Intellectual property and Client ownership
Upon full payment of the quoted price, the Client receives full ownership of the code, content and design of the delivered site. The Client may at any time request a complete export (files + database) to migrate to another hosting provider without losing anything. Hostynet retains no technical lock-in or buy-back right on the work delivered. Open-source components and third-party libraries used in the build remain under their respective licenses.
14.4 Monthly subscription, hosting and maintenance
Hostynet packs include a monthly subscription covering hosting on Hostynet infrastructure (France), automatic SSL certificate, technical maintenance and standard support. The Client is invited to keep their own copies of their content; a full export (files + database) is provided upon written request. Packs Pro and above include 1 hour of monthly modifications (non-cumulative, non-refundable, resets every billing cycle). Cancelling the monthly subscription does not affect the Client's ownership of the site (see 14.3): Hostynet provides a full export upon written request.
14.5 Additional hours
For modifications beyond the monthly inclusive scope, Hostynet offers prepaid additional-hour packs: 1 h (60 € ex-VAT), 5 h (250 € ex-VAT), 10 h (450 € ex-VAT), 20 h (800 € ex-VAT). DZ pricing in dinars on the published grid. Hours are valid 12 months from purchase, non-cumulative across multiple packs purchased on the same day, and non-refundable. Unused hours at the end of the validity period are forfeited.
14.6 Editorial content, images, third-party services
- Editorial assistance: briefs, page structure and tone advice are included in all packs.
- Visuals: royalty-free image banks (Unsplash, Pexels) are used by default, included.
- Custom photoshoot: Hostynet may, on request, put the Client in touch with a partner photographer. The photographer issues a separate quote and contract directly to the Client. This service falls outside the Hostynet contractual scope, Hostynet acting solely as an introducer.
- Custom illustrations, videos, drone footage: are the Client\'s responsibility upfront, Hostynet integrates them once received. They are not part of the standard pack.
14.7 Domain name
If a domain name is included, its scope and price are set in the quote. If the Client already owns a domain name elsewhere, Hostynet handles DNS migration free of charge. On contract termination, the Client retains their domain name.
14.8 Right of withdrawal (B2C)
For consumer Clients (B2C), the 14-day legal right of withdrawal (Article L221-18 of the French Consumer Code) does not apply once the project has effectively started, in accordance with Article L221-28, 1°: the Client expressly waives this right when accepting the quote with immediate start. If no work has yet started, the deposit may be refunded on simple written request within 14 days following quote signature.
14.9 Termination of the website service
The monthly subscription (hosting + maintenance) can be terminated by either party with 30 days written notice. The Client retains ownership of the site (see 14.3) and receives a full export (files + database) within 7 business days following effective termination. No refund of the lump-sum design fee. Hostynet may suspend the service in case of unpaid monthly subscription, following a formal notice remaining unanswered for 7 days.
14.10 Legal warranty of conformity (B2C)
Consumer Clients benefit from the legal warranty of conformity for digital services (Articles L224-25-12 et seq. of the French Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code). Hostynet undertakes to correct any nonconformity reported within the agreed scope at no cost, within a reasonable timeframe.
14.11 DZ clients (Algeria)
Hostynet offers a dedicated pricing grid for Algerian Clients (5 packs in DA, payment by CIB international card). DZ Clients are VAT-exempt under Article 259-1 of the French General Tax Code (services provided to a non-EU client). Sites can be delivered bilingual FR/AR upon Client request. A French-speaking representative based in Algeria can liaise with the Client.
15. Termination and disputes
Voluntary cancellation possible at any time from the client area, effective at the end of the paid period. In case of non-payment: service suspension after 3 days, termination and permanent deletion after 7 days.
16. Liability
Liability limited to the amount paid for the affected service.
17. Applicable law and jurisdiction
French law. For consumer Clients, the ordinary rules of jurisdiction apply. For business Clients, exclusive jurisdiction of the courts of the district where Hostynet's registered office is located.

Hostynet may amend these Terms at any time. Continued use after publication constitutes acceptance.
